Privacy Policy

DRAFT — FOR ATTORNEY REVIEW. NOT FOR PUBLICATION.

Effective Date: [DATE] Last Updated: [DATE]

1. SCOPE

This Privacy Policy explains how ROBUR ([LEGAL ENTITY NAME]) collects, uses, shares, and protects personal information when you use our website and apps.

We are the controller of the personal information described here.

2. INFORMATION WE COLLECT

2.1 Information you give us

Everyone: name, email address, phone number, password, and your communications with us.

Earners: legal name; date of birth; address / ZIP; taxpayer identification information (collected for IRS Form 1099 — we store only the last four digits in the app); payout account details (held by our payment processor, not by ROBUR); work categories you select; availability; your declared credentials and any documents you upload; your rate proposals; profile photo.

Mission Buyers: business name, EIN, business address, contact details, site information, certificate of insurance and related details, billing information (held by our payment processor).

Leads: if you submit a form on our website, we collect the details you provide so we can contact you.

2.2 Information generated when you use ROBUR

  • Missions you post, apply for, are selected for, or complete
  • Contracts signed (and timestamps)
  • Clock-in and clock-out times
  • Payments, payouts, fees, receipts, credits, and bonuses
  • Ratings you give and receive
  • Messages sent through the platform
  • Support tickets and dispute submissions

2.3 Location information — only with your consent

If you consent, we collect your device location while you travel to a Mission and while you are working it, in order to: show your estimated arrival to the Mission Buyer, confirm arrival at the site, and maintain a record in case of a dispute.

Location sharing stops automatically when you clock out. You can withdraw consent at any time in the app or in your device settings. Withdrawing consent may prevent you from using features that require it (for example, geofenced clock-in). We do not track you when you are not engaged on a Mission.

2.4 Clock-in photograph — only with your consent

If a Mission requires it, we capture a photograph of you at clock-in, to record who attended.

[COUNSEL — CRITICAL] If this photograph is or becomes a biometric identifier (for example, if a face-geometry template is generated or facial recognition is applied), then the Texas Capture or Use of Biometric Identifier Act (Tex. Bus. & Com. Code §503.001) — and, in other states, laws such as Illinois BIPA — impose informed-consent, retention, and destruction obligations. Counsel must confirm the correct characterization and finalize this section and the standalone biometric consent before this feature ships.

Current design intent: the image is stored as a photograph for human comparison and is not converted into a biometric template. See the Clock-in Photo Consent.

2.5 Device and usage information

Device type, operating system, app version, IP address, general location derived from IP, pages and screens viewed, and diagnostic/crash data.

2.6 Information from third parties

  • Background check reports — only where you have separately authorized a check, from a consumer reporting agency, under the Fair Credit Reporting Act.
  • Payment processor — payment status and payout confirmations from Stripe.
  • Identity verification — where used.

4. WHAT WE SHARE, AND WITH WHOM

4.1 Between users — only what is necessary.

  • A Mission Buyer you are engaged with sees: your first name and last initial, your profile photo, your clock times, your estimated arrival (if you consented to location), your declared credentials, and their own history with you.
  • An Earner you engage sees: your business name, site details, and the contact you provide.
  • The Mission Buyer is always disclosed to the Earner. We never conceal who you are working for.

4.2 Service providers. Payment processing (Stripe), background checks (consumer reporting agency, only with your authorization), cloud hosting, mapping, communications delivery, and analytics. They may process your information only for us and only as instructed.

4.3 Legal. Where required by law, subpoena, or lawful request; to protect rights, safety, or property; or to investigate fraud.

6. YOUR RIGHTS AND CHOICES

In every case, you can:

  • Turn location sharing off (in-app and in device settings)
  • Turn off non-essential notifications
  • Request a copy of your data
  • Delete your account

Deleting your account removes your profile from the platform. We must retain certain records — contracts, hours, and payment records — where law requires it (for example, tax records). We will tell you what is retained and why.

7. COMMUNICATIONS

We send service messages you cannot opt out of while you have an account (payment confirmations, contract notices, security alerts).

We send operational alerts (a Mission near you, an arrival reminder) — you can turn these off.

We send marketing messages only with your consent, and you can opt out at any time.

SMS: message and data rates may apply. Reply STOP to opt out, HELP for help. See the Communications Consent.

8. SECURITY

We use technical and organizational measures appropriate to the sensitivity of the data, including encryption in transit and at rest, access controls, and row-level database security. No system is perfectly secure. If a breach affects your information, we will notify you as required by law.
